Legislation overview
The use of cookies is governed by e-Privacy Directive and the General Data Protection Regulation (GDPR), and the European Data Protection Board (EDPB) supplement legislation with their guidance . In the UK, legislation is supplemented by guidance issued by the Information Commissioner’s Office (ICO).
The EU e-Privacy Directive (ePD) stipulates rules to protect the confidentiality of the information stored in computers, smart phones and similar devices. In particular, it requires users’ consent before anyone can store or access cookies, local shared objects ('flash cookies'), web beacons, bugs, viruses, and similar information on user’s devices. This is set out in Article 5(3) of the ePD.
The requirement to obtain consent is not applicable where the cookies in question are strictly necessary to the functioning of the website.
Consent is not defined in the ePD, therefore, the definition of consent under Article 4(11) GDPR is used to determine what constitutes valid consent.
Under Article 4(11) of the GDPR consent should be freely given, specific, informed and unambiguous.
The method of obtaining consent should be an unambiguous indication of the user’s wishes by which the data subject, either by a statement or by a clear affirmative action, signifies agreement to their personal data being processed by the data controller. This is further clarified in EDPB’s 2020 revision of the Guidelines that the “freely given” aspect of signifies that the user must be given opportunity to withdraw their consent without any detriment.
EDPB in Paragraph 86 of the Guidelines further state that “merely continuing the ordinary use of a website is not conduct from which one can infer an indication of wishes by the data subject to signify his or her agreement to a proposed processing operation”.
This was further clarified by Court of Justice of the European Union in Plant 49 case in 2019, where the court held that a pre-ticked box was not an indication of valid consent and that consent for one purpose cannot be used for consent for another purpose.
